Hello, and thank you for becoming a Food partner of Foodgrubber and using our FoodPartner App! We know you value your privacy, so this privacy notice explains in detail what personal data we collect from you and how we use it. We are committed to protecting the privacy of everyone at Foodgrubber. This includes protecting the personal data of all delivery partners including when they use our Foodpartner App. The terms "we", "us" or "our" refer to Foodgrubber, who will be the data controller.

You confirm that by using our FoodPartner Portal and FoodPartner App, you have read and understood our practices set out in this notice.

How Foodgrubber FoodPartner  App works and how it uses your personal data

To put it simply, our FoodPartner App allows you to receive notifications of food orders Opportunities that you can always decide to accept or reject. While you're checked in, the FoodPartner App allows great Customers to see your menu items and food.

To provide those services, our FoodPartner App needs to collect certain personal data from you and your device otherwise it won't work. Such data includes your name, surname, and your GPS location. For example, we show hungry customers your location, so they know where their food is and when to expect delivery. If we don't know your GPS coordinates, they won't know when to get ready at the door (so you don't end up waiting). The same is true for drivers, we show them where you are, so they can pick up the food. Both are designed to reduce the amount of time you spend waiting. 

Categories of personal data we collect and why

Personal data you provide voluntarily

In order to become a FoodPartner of Foodgrubber and log into the FoodPartner Portal you will need to complete the application process. As part of our on-boarding verification process, you are required to provide personal data such as your name, email address, and phone number in addition to other data – including your passport, national identity card, residence card or other documents – to show that you have the right to work and in order to verify your identity, driving license (so we are sure you can legally drive), a criminal disclosure certificate (or local equivalent) that is no older than six months, and details of your insurance certificate. We may also collect your credit or debit card information if you decide to purchase a FoodPartner kit via the Portal. We will only save this data if you request that we do so. This personal data will then be associated with the account you use to log into the App and will be used to enable us to send you orders, and to respond to any requests we receive from you. You may be required to complete a background check through our approved third party. Such checks may include a right to work check and a criminal record check, where permitted by local law. Any such information is held by our approved third party however we will receive and hold a copy of the results of your check.

Personal data we collect automatically through your use of FoodPartner App

We collect your GPS location automatically when you use FoodPartner App to deliver the App's key services.

Other data we collect

The FoodPartner App collects certain data about your mobile device automatically such as its model, manufacturer, MAC Address and software version. We use this data anonymously for analytical purposes to understand how our users interact with our services and it also gives us better insights to fix any technical issues that arise within the App.

From time to time, during your application process and/or once you become a Food partner, you may contact or be contacted by us by phone (e.g. to manage a request from you or to assist you in a possible issue arising from an order). Please note that during such calls, we may collect from you some personal data (as your name, phone number), and that such calls may be recorded for quality purposes. Our team will always make clear to you when the calls may be recorded, as well as the purpose of the recording activity.

Who else has access to your personal data?

We work with other companies within the Foodgrubber group and certain other third party service providers to provide FoodPartner App's services to you and deliver any purchased FoodPartner kit. These group companies and service providers will process your personal data on behalf of Foodgrubber (as data processors) or as autonomous data controllers, and have access to your personal data for the purposes described in this privacy notice, and we require them to protect it in accordance with the standards set out in this privacy notice. 

If you are processing an order, both the driver and the customer will be able to see your business name and your location.

In addition, we may also disclose your data to law enforcement agencies, competent government authorities and other third parties where we believe we are required to do so by applicable law or regulation (including a court order), or where we believe disclosure is necessary to exercise, establish or defend legal rights or to protect the vital interests of any person. We may also disclose your data to any company or prospective buyer of all or substantially all of Foodgrubber's assets in connection with any sale or transfer of those assets.

How we keep your data secure

We use appropriate technical and organisational measures to keep the personal data we collect about you secure at all times. In particular, these measures protect your personal data from unauthorised access and unlawful processing, accidental loss, destruction and damage. Please make sure you keep your user ID and password safe at all times. 

Where your data gets sent

We may transfer your personal data outside of the European Economic Area. This may include transferring it to or accessing it from other jurisdictions that may not provide a level of protection equivalent to the EU data protection laws. Where we transfer personal data we will take account of any applicable statutory obligations relevant to personal data transfers and, where there isn't a European Commission (EC) adequacy decision in place, we will rely on appropriate safeguards, including EC approved standard contractual clauses which we use as part of our intra-group transfer agreement at Foodgrubber: (see http://ec.europa.eu/justice/data-protection/international-transfers/transfer/index_en.htm). We have implemented similar appropriate safeguards with our third party service providers and further details can be provided upon request.

How long we retain your personal data

We will retain personal data related to your contract with Foodgrubber, including relevant financial statements and insurance information, for as long as you hold a FoodPartner App account with us, and for a set period following the termination, for any reason, of your account, in order to enable us to meet our legal, tax or accounting obligations or to issue or resolve legal proceedings. In the United Kingdom, this is usually 6 years after the closing of your FoodPartner App account. 

We will retain personal data contained in your background checks for as long as you hold a FoodPartner App account with us. However, we will only keep the copy of your criminal disclosure certificate for a maximum of six months from the date of issue.

For the same reasons, we will retain your data automatically collected from you and related to your GPS location for 1 year following the termination for any reason of your account. We will also retain the data related to the recorded calls with you for 1 year following their recording.

If you object to us processing certain categories of your personal data (including, where relevant, in relation to receiving marketing communications from us), we will retain a record of your objection to the processing of your data so that we can continue to respect your wishes.

We will destroy or permanently anonymise your personal data at the point that we no longer need to process it for our ongoing legitimate business needs or for any legal reason. If this is not possible (for example, because your personal data has been stored in backup archives), then we will securely store it and isolate it from any further processing until deletion is possible.

Legal basis for processing

We collect, use and process your personal data to perform our contract with you so that we can provide the services powered by the Foodpartner App (i.e. to help you manage your orders and to enable restaurants and customers to see where you are). 

We also process your personal data in order to comply with legal obligations (e.g. in the event of legal proceedings or in order to comply with employment/social security laws, such as ensuring that you have the right to work) or we might need to process it or share it with others to "protect your vital interests" (this is legal speak for saving your life) or those of another person (e.g. in a case where another person's life is in danger).

The provision of your personal data is necessary for the execution of the contract with you and/or for the fulfillment of legal obligations; without your personal data Foodgrubber may not be able to establish and/or continue the contract with you.

When we collect data related to your GPS location we ask for your prior and specific consent, also by means of specific features of the FoodPartner App. 

Your specific consent, which may be expressed through the FoodPartner App, is also required for the use of tracking technologies. 

You can withdraw your consent at any time, but if you do, you may not be able to use all the functions of the FoodPartner App.

Similarly, we will seek your specific and prior consent in the event we wish to target you with our direct marketing communications. 

The processing of personal data is in any case based on the principles of proportionality and necessity, for which personal data that are not necessary will not be processed or collected, the principle of fairness and transparency, which entails that it will always be given adequate notice to you about the processing operations carried out, and in compliance with the requirement of adequacy of security measures.

We may also use your personal data where it is in our legitimate business interests to do so (but only if our interests are not overridden by your data protection interests or your fundamental legal rights and freedoms). For example, your personal data we collect from the recording activity of the calls with you are used for quality purposes. Whenever we process data for these purposes we will ensure that we always take into account your personal data rights and we will make clear to you at the relevant time what those legitimate interests are.

Your rights

We inform you that, with regard to the personal data, you can exercise the rights provided for by the GDPR which include, among others: the right to request access to, rectification of, or erasure of personal data or restriction of processing, and to object to processing, the right to data portability, to withdraw your consent at any time (without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal) as well as to lodge a complaint with the Italian Supervisory Authority.

We may update this privacy notice from time to time in response to changing legal, technical or business developments.
